Definitions

“Chicago Genetic Consultants, LLC”, “EH”, “We”, “Our” or “Us” — Chicago Genetic Consultants, LLC includes our telehealth services.

Accounts, passwords and security

Eligible users of Chicago Genetic Consultants, LLC Services

Chicago Genetic Consultants, LLC is committed to protecting the privacy of children and complies with the Children’s Online Privacy Protection Act. As such, the Chicago Genetic Consultants, LLC Services are not intended for or directed to children under the age of 13. If you are under the age of 18 (or under the age of majority set by the applicable laws of the State in which you are located), please do not use the Chicago Genetic Consultants, LLC Services without being supervised by a parent or legal guardian who agrees to be bound by these Terms. License grant

Chicago Genetic Consultants, LLC grants you a personal, revocable, limited, non-exclusive, non-transferable license to access and use the Chicago Genetic Consultants, LLC Services, provided you accept and comply with these Terms. You may use the Chicago Genetic Consultants, LLC Services for your non-commercial personal or educational use. Please do not use the Chicago Genetic Consultants, LLC Services for any other purpose.

License restrictions

Unless you receive Our prior written consent, you may not modify, translate, create derivative works of, copy, distribute, market, display, remove or alter any proprietary notices or labels from, lease, sell, sublicense, clone, transfer, decompile, reverse engineer, or incorporate into any information retrieval system (electronic or mechanical) any portion of the Chicago Genetic Consultants, LLC Services.

Intellectual property rights & license

For as long as you comply with these Terms, Chicago Genetic Consultants, LLC grants you a limited, non-exclusive, non-transferable license (“Content License”) to use the Content solely for your non-commercial personal or educational use. Except for the express, limited Content License set forth in this paragraph, We reserve all other rights in and to the Content.

If you cannot comply with the limitations of the Content License, Chicago Genetic Consultants, LLC may revoke or terminate your Content License. Any unauthorized use, reproduction or distribution of the Content is strictly prohibited and may result in termination of the Content License, as well as potential civil and/or criminal penalties.

Sharing content

You may download, copy or otherwise use the Content and other downloadable items displayed on the Chicago Genetic Consultants, LLC Services (“Downloadable Content”) for non-commercial personal or educational uses. If you download, copy or otherwise use Downloadable Content, you are required to maintain all copyright, trademark and/or other notices contained therein. Copying or storing of any Content for purposes other than non-commercial personal or educational use is expressly prohibited without prior written permission from Chicago Genetic Consultants, LLC. Submissions

You are solely responsible for the information that you post, share, email, transmit or otherwise make available via the Chicago Genetic Consultants, LLC Services (“Submission”). All Submissions are subject to these Terms. Chicago Genetic Consultants, LLC is under no obligation to post or use any Submission and may remove any Submission at any time in its sole discretion.

By making a Submission, you represent and warrant that your Submission is true, accurate and not misleading; that you own all right, title and interest, including copyright, to your Submission, and that your Submission is your own original work; that your Submission does not include the trade secret or confidential information of others, and does not infringe any other person’s or entity’s rights; and that you and any other person or entity (or its owner) mentioned or shown in your Submission hereby release and hold harmless Chicago Genetic Consultants, LLC and its designees from and against any and all claims concerning Chicago Genetic Consultants, LLC’s or its designees’ use, modification or distribution of the Submission or any part thereof. You must hold all necessary releases, licenses and consents concerning the contents of your Submission and rights to post, distribute, or transmit your Submission.

You agree that you will evaluate and bear all risks associated with your Submission and any disclosure in your Submission. Submissions will be available to Chicago Genetic Consultants, LLC Site users and to users of other websites and services.

By making a Submission, you grant Chicago Genetic Consultants, LLC and its affiliates, licensees, assignees and designees an irrevocable, assignable, transferable, fully sub-licensable (through multiple levels of sublicensees), perpetual, world-wide, royalty-free, fully paid-up, non-exclusive license, in their sole discretion, to use, distribute, reproduce, modify, combine, adapt, publish, translate, rent, lease, sell, publicly perform, publicly display and create derivative works of your Submission (in whole or in part), along with your name or any part thereof, your city/town/village of residency, and other information from your user profile, in Chicago Genetic Consultants, LLC’s sole discretion, via the Chicago Genetic Consultants, LLC Services or elsewhere, and to use or incorporate all or any part of your Submission into other advertising, promotion, marketing, review, recommendation, research, analysis or other materials in any format or medium now known or later developed. You hereby waive any right to inspect such use and waive, release, and hold Chicago Genetic Consultants, LLC and its affiliates, licensees, assignees and designees harmless against any and all claims based on privacy, publicity, defamation, misappropriation, intellectual property or similar claims for any use of your Submission.

Chicago Genetic Consultants, LLC, or one of our authorized third-party vendors, may offer text messaging services/notifications (including Short Message Service or “SMS”, Multimedia Messaging Service or “MMS” messages, and push notifications, collectively “Text Messages”) for our patients, customers, donors, and guests. We offer a wide range of text messaging programs depending on the services We provide to You and how You choose to engage with Us (the “Chicago Genetic Consultants, LLC Texting Services”). Chicago Genetic Consultants, LLC uses Text Messages as a convenient way to communicate with You about:

Your health, such as test results, patient health maintenance follow-ups, patient education, operational updates (for example: appointment reminders), and account/billing information;
News and event information;
Philanthropic information and opportunities; and
Marketing materials about services and offerings that may interest you.

Generally, you may be asked if you want to subscribe to one of our Chicago Genetic Consultants, LLC Texting Services at any of Our patient registration desks, through our pre-registration call center. You may also subscribe to Chicago Genetic Consultants, LLC Texting Services by subscribing through our Chicago Genetic Consultants, LLC Websites, Chicago Genetic Consultants, LLC Patient Portals, other web forms, emails, or by texting “START” to a specific short code. Whatever the process, You will need to provide Us with your mobile number to subscribe you to receive Text Messages. For Text Messages sent from Chicago Genetic Consultants, LLC Patient Portals, please note that You can unsubscribe from or customize the Text Messages you receive by logging in to your account and managing your communication preferences.

Under the Healthcare Exemption of the TCPA (Telephone Consumer Protection Act), when You provide Us with your mobile number, You automatically provide consent to receive certain Text Messages about Your personal healthcare as part of your established relationship with Us. These notifications may be limited to Text Messages that are important in providing You with timely information specific to your personal healthcare needs. In addition to these terms, Telephone carriers (“Carriers”) require us to have terms of use connected to the specific short code that sends You Text Messages (“Short Code Terms”). In addition to agreeing to the terms in this section, You must also agree to these Short Code Terms for you to receive Text Messages from that short code. These additional Short Code Terms are found below in the Additional terms section below.

The terms of use that apply to the Chicago Genetic Consultants, LLC Texting Services vary depending on the services being provided and the information being shared. BY SUBSCRIBING TO OR USING AN CHICAGO GENETIC CONSULTANTS, LLC TEXTING SERVICE, YOU ACCEPT AND AGREE TO THESE MOBILE TEXT MESSAGING TERMS OF USE. YOU ALSO ACCEPT AND AGREE TO THESE MOBILE TEXT MESSAGING TERMS OF USE THROUGH YOUR USE OF YOUR MYCHART PATIENT PORTAL ACCOUNT. When you subscribe to a particular Chicago Genetic Consultants, LLC Texting Services, We may send you a confirmation message of your sign-up, also allowing you to reply “STOP” to no longer receive any Text Messages from that specific Chicago Genetic Consultants, LLC Texting Service. Sending a “STOP” request must be completed separately for each Chicago Genetic Consultants, LLC Texting Service or third-party vendor service to unsubscribe. Sending one “STOP” request will not create an unsubscribe for all Chicago Genetic Consultants, LLC Texting Services and program short codes, enabling you to selectively decide what information you would like to receive. Consent to receive marketing text messages is not required as a condition of receiving any health care services. Text Messages from third-party vendors

Depending on the care You receive from Chicago Genetic Consultants, LLC, You may be asked if you would like to subscribe to receive Text Messages from one of our third-party vendors. These third-party vendors may provide texting services related to your care, such as financial assistance information, billing information, medication prescriptions, health maintenance, appointments and scheduling. Depending on the third-party texting service, you may be asked to separately consent to receive those Text Messages and agree to additional terms and conditions and privacy terms from that third-party. Please review that information carefully before subscribing to these texts. Third party vendors may send Text Messages disguised as alerts from Chicago Genetic Consultants, LLC and therefore You are urged to independently verify the authenticity of any Text Message that you receive. You hereby agree to release and hold harmless Chicago Genetic Consultants, LLC and its designees from and against any claims concerning any texting services from such third-party vendors.

Text message scams & fraud

We understand that receiving text messages from an organization can sometimes raise concerns about their legitimacy. If you ever receive a text message from us that seems suspicious or if you have any doubts about its authenticity, we encourage you to contact us immediately, and we can assist you with the verification of the communication you received.

Mobile Carriers & additional terms

Chicago Genetic Consultants, LLC, CC Providers, and mobile carriers are not liable for losses or damages arising out of delayed, misdirected or undelivered messages. Please note, however, that the supporting mobile carriers may change without notice, and the Chicago Genetic Consultants, LLC Texting Service you subscribe to, including those operated through a different number, may be limited to specific carriers. Text Messages may be delayed or not received during regional emergencies or other periods of high messaging traffic. Text Message order delivery is not always predictable. Text Messages from Chicago Genetic Consultants, LLC will be presented on your mobile device in the same manner as any other SMS text messages. There may be occasions where the full contents of the Text Message may not be delivered to your phone.

Supported mobile carriers may change from time to time, but Chicago Genetic Consultants, LLC Texting Services are currently supported on the following U.S. carriers, including but not limited to: Verizon, AT&T, T-Mobile, Sprint, Boost, U.S. Cellular, Virgin Mobile Cricket Wireless, Metro, Xfinity Mobile, Spectrum Mobile, Mint Mobile, Straight Talk Wireless and Google Fi. You are encouraged to check with your mobile carrier to learn more about their coverage, plans and costs.

Use of the Chicago Genetic Consultants, LLC Services

When accessing, browsing or using the Chicago Genetic Consultants, LLC Services, please do so responsibly. Do not violate any local, state or federal law, rule or regulation. Also, do not violate any contract or third-party right, such as intellectual property or other proprietary rights. Click-through agreements

Applicable law

WHILE CERTAIN JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SUCH LIMITATION MAY NOT APPLY TO YOU. Indemnification

Term and termination
